These terms apply to use of danflashes.us and purchases from Dan Flashes Inc. ("Dan Flashes," "we," "us" or "our"). Review them together with our Shipping Policy, Refund Policy and Privacy Policy.
Orders and account information
Provide accurate contact, billing and delivery information and use a payment method you are authorized to use. You must have the legal capacity to enter into the transaction. Keep account access information secure and contact us if you suspect unauthorized use.
An order-confirmation email records the order details. Contact us promptly if something is incorrect. We may reasonably refuse, limit or cancel an order because of payment failure, suspected fraud, unavailable stock, an obvious pricing error or a destination we cannot serve, subject to applicable law. If we cancel a paid order, we will refund the affected payment. We will not increase the agreed price after purchase without your consent.
Prices, payment and promotions
The currency, item prices, applicable discounts and charges collected with the order are displayed before you complete checkout. Third-party currency-conversion fees or import charges may apply as explained in our payment and shipping policies.
Payment must be authorized before processing. Available payment methods are those displayed at checkout for the order.
Promotions, including Buy 3 Get 1 Free, apply to eligible products under the conditions displayed with the offer and reflected at checkout. Review the final order total before paying. Offers are not interchangeable with cash, and combining offers depends on their stated conditions. Changes to a promotion do not retrospectively remove a discount already accepted with an order.
Product information
Product descriptions, selected variants and applicable size guidance form part of the information provided before purchase. Screen settings can affect colors, but do not excuse supplying materially different goods. Products must meet applicable legal requirements concerning description, quality and fitness for purpose.
Shipping, cancellations and refunds
Our Shipping Policy explains processing, delivery estimates, tracking, customs and delayed orders. Email us promptly to request an address change or cancellation. Cancellation is available before an order enters processing for shipment; operational changes may no longer be possible after that point. Statutory cancellation and withdrawal rights remain unaffected.
Our Refund Policy explains 30-Day Refunds for eligible order problems, voluntary sizing or change-of-mind options, and mandatory consumer remedies. These terms do not require you to accept store credit in place of a legally required refund, wait 90 days for an earlier legal remedy, or waive lawful payment-dispute rights.
Intellectual property and customer content
Website materials may be protected by intellectual-property laws. Rights in individual materials belong to their respective rights holders. Do not reproduce or use protected materials beyond what the law or the relevant rights holder permits.
If you submit a review, photograph or other content, submit only material you have the right to provide. You retain any rights you hold in it. Permission to display submitted content does not transfer ownership to us or authorize unrelated uses beyond your consent and applicable law.
Acceptable use
Do not use the website to commit fraud, infringe others' rights, introduce malicious code, gain unauthorized access or interfere with the service. We may restrict misuse where reasonably necessary and lawful, without removing rights connected with an existing legitimate order.
Third-party services and availability
Our store uses third-party services, including Shopify, payment providers and delivery partners. Separate terms may apply to their independent services. This does not remove our own responsibilities to you as the seller.
Website access may occasionally be interrupted for maintenance or other reasons. We do not guarantee uninterrupted access. Nothing in these terms excludes liability for fraud, applicable product or safety obligations, or any liability or consumer right that cannot lawfully be excluded.
Governing law and disputes
These terms are governed by the laws of Manitoba and applicable federal laws of Canada. This choice does not deprive consumers of mandatory protections or available legal forums under the laws that apply to them.
Contact danflashes@danflashes.us if there is a problem so we can try to resolve it. Contacting us is not a waiver of your right to contact a payment provider, regulator or court, and does not extend any filing deadline.
Updates and contact
The terms disclosed when you place an order apply to that order, subject to applicable law. Later revisions do not retroactively reduce your rights. If a provision cannot be enforced, the remaining provisions continue only to the extent permitted by law.
